Scope

These Terms of Use govern access to and use of the Tiapla appointment booking platform, including the web console at console.tiapla.de and the embeddable booking widget (collectively "the Service"). By using the Service, you agree to these Terms.

Free Provision – No Warranty

The Service is provided entirely free of charge and without any warranty of any kind. It is offered "as is" and "as available". The operator makes no guarantee regarding availability, reliability, error-freedom, or fitness for a particular purpose.

Use of the Service is entirely at your own risk.

Client Responsibilities

Clients – businesses and individuals who use Tiapla to offer booking functionality to their own end users – are solely responsible for their use of the Service and for compliance with all applicable laws, including the GDPR/DSGVO.

Clients are in particular responsible for: maintaining their own valid privacy notice that informs end users about data processing; ensuring a lawful legal basis for collecting end-user data; and the accuracy and lawfulness of all data entered into the Service.

Clients may not use the Service for unlawful purposes or in a way that infringes the rights of third parties.

Limitation of Liability

Because Tiapla is a gratuitous service (unentgeltliche Leistung), the operator's liability is limited to cases of intentional misconduct (Vorsatz) pursuant to § 521 BGB. The operator is not liable for damages arising from the use or unavailability of the Service, including loss of data, business interruptions, or financial loss resulting from ordinary negligence.

This limitation applies to the fullest extent permitted by applicable law. Statutory liability for bodily injury remains unaffected.

Data Protection and Data Processing Agreement

Clients who embed the booking widget on their website and thereby cause personal data of their end users to be processed via Tiapla act as the data controller under GDPR. Tiapla acts as a data processor on their behalf. A Data Processing Agreement (DPA) compliant with Art. 28 GDPR is available at

. By using the Service, clients agree to be bound by the DPA.

Availability

The operator endeavours to keep the Service running but makes no commitment to any specific uptime or availability. The Service may be interrupted for maintenance, updates, or reasons beyond the operator's control without prior notice.

Termination

The operator reserves the right to suspend or permanently terminate access to the Service for any client that violates these Terms or applicable law, or whose use is deemed harmful. The operator also reserves the right to discontinue the Service entirely, with reasonable advance notice where feasible.

Changes to These Terms

These Terms may be updated at any time. The current version is always available at this URL. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed exclusively by German law. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Germany, to the extent permitted by law.
